Extremely Important..CFA has been informed that some retailers who have registered as deposit initiators have yet to submit “escheat” payments on beer and soda by the April 30,2009 due date as shown on the attached initial correspondence. Please check with the accounts payable dept of your company to see if you have complied with the law. Forms can be found on CT Gov website as shown below. If you have any questions or need further help in compliance, please call Tom Tyler at DEP 860 424 3099. You are subject to fines if you do not comply.
Here is a recap of the key action dates that have been communicated to CFA members. Please check to see if your company has complied. All details, Q and A’s , forms can be found on CT Gov’s website under DEP- CT Bottle Law. - Public Act 09-02 expanded the CT bottle law to include water, flavored water, fitness waters, etc. 5 cent deposit would be required on water containers less than 3 liters. It exempted containers made with HDP. Two cent handling fee would apply to water.
- Original effective date of 4/1/2009 was waived to 10/1/2009. Copy of confirmation letter will be in 3/27 “ Food for Thought”. All covered water containers sold in CT must have “ plus 5 cent CT deposit” wording on them by that date. Nickels would be collected from consumers on that date. If you are a deposit initiator your “private label” water information would have to included in your required Quarterly Filing Report.
- By 4/1/2009. Any manufacturer who bottles and sells less than 250,000 noncarbonated containers can file for exemption from the law. Form on DEP website.
If you are a Deposit Initiator, here’s a summary of the key dates and actions required: - By 1/5/2009. Deposit Initiators had to open a new separate bank account at a CT branch of a financial institution. The “refund value-5 cent” for each container sold in CT must be deposited in this account. A Notification Form sent to DEP.
- By 1/5/2009. Full refund value of all covered beverage containers sold between 12/1 to 12/31/2008 deposited in account.
- On and after 1/1/2009. Refund value of covered containers must be deposited in this account not more than 30 days after product sold.
- 3/15/2009. Report refund values received and paid for period 12/01/2008 thru 02/28/2009. No payment required.
- 4/30/2009. Report refund values received and paid for period 12/01/2008 thru 03/31/2009. Payment due.
- 7/31/2009. Report refund values received and paid for period 4/1/2009 thru 6/30/2009. Payment due.
- 10/31/2009. Report refund values received and paid for period 7/1/2009 thru 9/30/2009. Payment due.
- 1/31/2010. Report refund values received and paid for period 9/30/2009 thru 12/31/2009. Payment due.
